Judge Recommends Lighter Sentence for Soldier

Fort Campbell, Ky. - A judge has said he will recommend a lighter sentence for a Fort Campbell soldier convicted of murdering an Iraqi detainee.

 

A military spokeswoman said Col. Theodore Dixon also denied a motion for a mistrial by 1st Lt. Michael Behenna of Edmond on Friday. A military jury last month convicted Behenna of murder and sentenced him to 25 years.

 

Staff Sgt. Joy Kroemer, a spokeswoman for the 101st Airborne Division, said Dixon will recommend to the convening authority, typically the commander of the installation or division, that Behenna serve no more than 18 years.

 

Behenna's attorney, Jack Zimmermann, has said he will appeal if the judge denied the motion.
