Attorney: Fort Campbell Soldier Did not Kill Detainee

Nashville, Tenn. - The lawyer for a Fort Campbell soldier charged with premeditated murder says the soldier did not kill an Iraqi detainee and will fight the charges.

 

James Phillips, a Clarksville attorney, also said a hearing for Staff Sgt. Hal M. Warner has been reset again to give the civilian attorneys time to travel to Iraq.

 

Warner and 1st Lt. Michael C. Behenna, both of Oklahoma, are accused of shooting Ali Mansour Mohammed "at or near" their forward operating base north of Baghdad and then lying about it.

 

Phillips told The Associated Press that there were Iraqi witnesses to the death of the detainee and their eyewitness accounts will be a part of the Article 32 hearing, now set for Sept. 11.

 

A hearing for Behenna has not yet been set.
