Today was the last day for the attorney, of the Rigby High School student turned Army Sniper, to file motions before the head to trial for murder on February 28th.

The first motion for Army Sniper Evan Vela's murder trial, was submitted to move the trail to Alaska.

The reason was because his fellow soldiers and witnesses to the incident have all left Iraq and are back in Fort Richardson.

The second motion is to move Vela's military confinement from Iraq to Germany, to improved conditions.

This all stems from an incident in June when Vela was arrested for shooting an unarmed Iraqi and was sent to military confinement.

In August, a JAG lawyer did recommend Vela plea guilty, and face no more than 17 years in prison but Vela's family found that unacceptable and hired a costly but top-notch legal team.

Vela says he was following orders when he shot the Iraqi.

If the trial is not moved to Alaska that means some soldiers who just arrived home will have to go back to Iraq just to testify.

Two other US soldiers who had similar charges have been acquitted.

The family is asking for help with legal bills.
